End User License Agreement (EULA) for "Pet Care Pro Mobile App"

IMPORTANT – PLEASE READ CAREFULLY:

This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and mcSquared AI LLC, the developer and provider of the Pet Care Pro Mobile App (the “App”). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App.

1. LICENSE: a. Grant of License. mcSquared AI LLC grants you a non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial purposes, subject to the terms and conditions of this EULA. b. Restrictions. You may not: (i) modify, reverse engineer, decompile, or disassemble the App; (ii) rent, lease, loan, sublicense, or create derivative works from the App; (iii) make any copies of the App, except as expressly permitted in this EULA or by law; (iv) remove any proprietary notices or labels on the App. c. Termination. Your license to use the App will terminate automatically if you violate any terms of this EULA. Upon termination, you must cease all use of the App and destroy any downloaded or installed copies.

2. INTELLECTUAL PROPERTY: a. Ownership. The App and its contents, features, and functionality, including, but not limited to, all information, software, code, text, graphics, logos, and all other related materials, are owned by mcSquared AI LLC or its licensors and are protected under international copyright, trademark, and other intellectual property laws. b. Feedback. If you provide any feedback or suggestions about the App, mcSquared AI LLC may use such feedback or suggestions without obligation to you.

3. DISCLAIMER OF WARRANTIES: The App is provided “AS IS” and without warranty of any kind, express or implied, including, but not limited to, warranties of performance, merchantability, fitness for a particular purpose, accuracy, omissions, completeness, currentness, and delays.

4. LIMITATION OF LIABILITY:

   • General Limitations: To the fullest extent permitted by applicable law, mcSquared AI LLC will not be liable for any damages arising out of the use or inability to use the App, even if advised of the possibility of such damages.

   • Pet Health and Related Issues: mcSquared AI LLC and its Pet Care Pro app will not be liable for any damages, including but not limited to, pet health complications, worsening of any symptoms or behavior, and/or death of the pet, regardless of whether the user utilized the Pet Care Pro app before, after, or at any other time relative to when the damages occurred.

   • User Actions and Inactions: Pet Care Pro and mcSquared AI LLC are not liable for the actions or inactions of the user, regardless of the recommendations or communications of the app in response to any input by the user.

5. GOVERNING LAW: This EULA will be governed by the laws of the State of Illinois, without reference to its choice of law rules.

6. AMENDMENTS: mcSquared AI LLC reserves the right to modify this EULA at any time by providing such revised EULA to you or posting the revised EULA in the App.
